Terms of Service

By accessing or using Forager — including the forager.app website and the Forager Free Food Alerts SMS program (together, the “Service”) — you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

Forager finds and surfaces free food deals, BOGO offers, birthday giveaways, and similar promotions from restaurants and chains, and delivers curated alerts to subscribers — currently by SMS text message, with a mobile app planned for the future.

We do not sell food, process orders or payments, or control restaurant pricing, inventory, promotions, store policies, or employee behavior. Forager is not affiliated with or endorsed by the restaurants or brands referenced within the Service unless explicitly stated. Restaurant names and logos are used for identification purposes only.

The following terms govern the Forager Free Food Alerts text-message program:

• Consent. By checking the consent box and submitting your phone number through the sign-up form on our website, you provide your express written consent to receive recurring automated marketing and informational text messages (e.g., free-food deal alerts and service messages) from Forager at the number provided. The consent box is never pre-checked, and consent is not a condition of any purchase.
• Message frequency varies. You may receive a sign-up confirmation and recurring deal alerts (typically a few messages per week once alerts are live).
• Message and data rates may apply according to your mobile carrier plan.
• Opt out at any time by replying STOP to any Forager message. You will receive one final message confirming your opt-out. After that, you will receive no further messages unless you re-subscribe.
• Help. Reply HELP to any message or email hello@forager.app for assistance.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is outside our control.
• Eligibility. The program is intended for U.S. residents. You represent that you are at least 18 years old (or have the consent of a parent or guardian), that you are the owner or customary user of the phone number you provide, and that you will notify us if you relinquish that number.

Your mobile opt-in data will never be shared with third parties for marketing purposes — see our Privacy Policy for details.

Forager surfaces free-food deals, BOGO promotions, birthday rewards, coupons, and similar offers from third-party restaurants, chains, and partners (“Offers”). Offers are provided for reference and convenience only.

• Offers are controlled by the restaurant, chain, or partner that issues them — not by Forager. They may be limited in quantity, time-restricted, regional, account- or app-restricted, or subject to additional terms set by the issuer.
• We do not guarantee that any Offer is currently active, valid in your area, or that it will be honored. Offers can expire, sell out, or change without notice.
• You are responsible for reviewing and complying with the issuer’s terms, eligibility requirements, and any purchase or membership conditions tied to an Offer.
• Forager is not responsible for Offers that are refused, expired, regionally unavailable, or otherwise not honored, and is not liable for any cost, travel, or inconvenience incurred in pursuit of an Offer.

By using Forager, you agree that:

• You will only submit a phone number that you own or customarily use, and never sign up someone else’s number without their consent.
• You will verify any deal directly with the restaurant before traveling or ordering.
• You will use the Service lawfully and will not scrape, harvest, mirror, reverse-engineer, or otherwise abuse the Service’s website, APIs, data, or infrastructure.
• You will not automate the Service, run bots against it, or use it to harvest data for resale.
• You will behave respectfully toward restaurant employees and other customers when acting on information from Forager. Offers are subject to individual store policies and employee discretion.

We do not guarantee that any deal, price, or promotion shown or texted by Forager will be available, honored, or redeemable at any location. Restaurants may change prices, promotions, or policies at any time without notice. Alerts are best-effort: we are not liable for missed, delayed, duplicated, or undelivered messages.

All content, branding, design, data presentation, code, and other materials within Forager are the property of Scale Ventures LLC or its licensors and are protected by applicable intellectual property laws. Unauthorized reproduction, scraping, mirroring, redistribution, or commercial reuse is prohibited.

Third-party trademarks, including restaurant names and logos, are the property of their respective owners and are used for identification purposes only.

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Forager and Scale Ventures LLC shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Service, including but not limited to losses resulting from:

• Incorrect or stale deal, pricing, or availability information.
• Offers that are expired, refused, regionally unavailable, or otherwise not honored.
• Wasted travel, fuel, time, or missed opportunities.
• Missed, delayed, duplicated, or undelivered text messages.
• Reliance on any data or information presented by the Service.

You use Forager at your own risk and assume full responsibility for decisions made based on the information it presents.

You agree to indemnify and hold harmless Scale Ventures LLC, its officers, members, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service.

We may suspend or terminate your access to the Service — including removing your number from the alert program — at any time, with or without notice, if you violate these Terms, abuse the Service, or pose a risk to other users or the platform. You may stop using the Service at any time by replying STOP to any message. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) continue to apply after termination.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify subscribers by text or post a notice on the site. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to conflict-of-law principles. You agree that any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Michigan.
